Legal remedies may not be brought to the German bid protest institutions ("Vergabekammer") because GTI is not a contracting authority or entity pursuant to § 98 GWB. GTI is therefore not bound by public procurement law. GTI performs this tender pursuant to the SektVO voluntarily and only to effectively promote competition, transparency, and fairness.

Due to the shareholder structure of GTI, GTI considers the official bid protest authorities ("Vergabekammern", "Vergabesenate der Oberlandesgerichte") to be inapplicable for review procedures in this matter. Therefore, the "Landgericht Hamburg" (Regional Court) is announced in this notice as the competent body. However, if the official bid protest authorities should have jurisdiction, the following "Vergabekammer" would be competent:

In addition, reference is made to Section 160 (3) of the GWB. In particular, Section 160 para 3 no 4 GWB provides that a bid protest is inadmissible if more than 15 calendar days have elapsed since receipt of the contracting entity's notification that it does not intend to remedy the complaint.
