The 8ra project FACIS addresses key challenges in digital infrastructure, particularly interoperability, governance, and the growing need for flexible, decentralized solution architectures. By combining innovative technologies - including Federation Architecture Patterns (FAPs), machine-readable Service Level Agreements (SLAs) and low-code approaches - with a robust governance framework, FACIS supports seamless interaction between cloud and edge components across different providers.
A particular focus is on the development of an free and open-source Digital Contracting Service (DCS) that supports qualified electronic signatures such as EUDI (European Digital Identity) standards and enables secure, legally compliant digital transactions.

The DCS shall enable automated, secure, and legally compliant contract creation, negotiation, signing, and lifecycle management. It is designed to operate seamlessly across sovereign IT environments, supporting multi-party and multilateral contracting scenarios essential for dynamic service orchestration in federated edge and cloud infrastructures.

The purpose of this award is to commission software development services for Lot Digital Contracting Services by using the Eclipse Project XFSC (Cross Federation Services Components) as the foundation (https://projects.eclipse.org/projects/technology.xfsc). The integration of EUDI will be tendered in a separate tender procedure.

For further participation and the processing of the documents, it should be noted that the development team must be complete as soon as the order is placed so as to be able to provide the development services on time and with the required quality.

Conditions for participation

Suitability and permission to pursue the professional activity

1. The bidders must also complete the eligibility self-declarations pursuant to Sections 123 and 124 of Act against Restraints of Competition - GWB (cf. Section 31 (1) regulation on sub-threshold procurement - UVgO). The bidders must submit these with the participation application.

2. Extract from the relevant register not older than 6 months (since publication of the notice) for the company and - if envisaged - members of the bidding consortium as well as subcontractors to be used by way of suitability lending, in each case insofar as corresponding statutory register obligations exist.

3. The applicant must submit the following self-declarations according to the collection of forms:
- Self-declaration that the company is not in liquidation.
- Self-declaration that the company fulfils its obligations to pay taxes and duties.

Economic and financial standing

1. Self-declaration of the company's total turnover in relation to the last three completed financial years in accordance with the collection of forms.

2. The annual minimum turnover in each of the last three calendar years (2022-2024) must be at least EUR 100,000 net.

3. Proof of existing business liability insurance/professional liability insurance (copy) with a minimum amount of:

- EUR 1,000,000 for personal injury and property damage
- EUR 500,000 for financial losses

The above-mentioned amounts of cover must be available at least twice per insurance year.

In the case of bidding consortia, proof of insurance must be provided for each member.

In the case of a lower coverage of the liability insurance, confirmation from the insurance company stating that the coverage amount can be increased accordingly in the event of an order is sufficient.

Technical and professional ability

1. Self-declaration of at least 1 reference of essentially comparable services performed in the years 2022-2025 (by the end of August) in accordance with the service description (the service must have been accepted in the essential parts within this period, or approx. 90% of the remuneration must have been paid). A reference service is deemed comparable with the services being awarded here if it is similar to them in terms of content, type of service, degree of difficulty, technically and organisationally to such an extent that it allows a valid conclusion to be drawn about the bidder's capability to perform the tendered service.

Up to 3 references can be included in the assessment. If more than 3 references are submitted, the first three references in the submitted form (reference no. 1, 2 and 3) will be used for the assessment.

In the case of bidding consortia, the reference must have been provided by a member of the consortium (i.e., not by each individual member).

The references will be evaluated as follows:

- Criterion 1: The reference project took place in the OSS environment;
Proof: (1) Reference to publication on OSS platforms such as Gitlab, etc.; (2) Details about the use of open standards/frameworks;
Score: Minimum requirement 1 reference, 1 point per reference (max. 3 points)

- Criterion 2: The reference project was implemented in a "lead role". The term "leading role" does not refer to the contractual aspect (main contractor) but to the content-related responsibility of the project (also possible as a subcontractor)
Score: 0.5 point per reference (max. 1.5 points)

-Criterion 3: Scope of the order:
Proof: Number of person days;
Score: 0.05 points per complete 100 person days (from 200 = 0.1 points, from 300 = 0.15 points, etc.); From 2000 person days max. 1 points
(max. 3 points)

A total of 7,5 points can be scored overall. At least 1 reference must be submitted; a maximum of 3 references will be considered when awarding points. In the event of a tie, the bidder with the largest single project, measured in number of person days will determine the ranking.

The client reserves the right to check the accuracy of the information provided and to demand suitable proof of this at short notice.

Applicants who do not submit the required minimum number of at least one (1) suitable, evaluable reference on comparable services will be excluded from the award process. If applicants submit more than one reference, they do not have to come from different contracting authorities in order to be assessed.

2. A self-declaration is required to demonstrate that the company has the necessary personnel and technical resources to execute the contract properly.

Additional information

After evaluation of the participation applications, the candidates selected for the next stage of the process will be invited to submit their tenders on the basis of the award documents.

In the event that more than 5 eligible requests to participate are received, the client will limit the group of candidates to 5 on the basis of an evaluation of the participation applications in accordance with the criteria listed above (§ 36 regulation on subthreshold procurement - UVgO). Only those candidates who are ranked in the top 5 after this evaluation will be invited to submit tenders.

The companies that are not selected will receive a notification that they will not be further involved in the process.

The examination of the participation applications shall otherwise be carried out in accordance with the requirements of Section 41 regulation on subthreshold procurement - UVgO.

Please note that the bid amount shall not exceed 420,000 Euro net.
