The scope and nature of the services that may be delivered under the Framework Agreement incorporate the following IT Professional Service types: Application Development and System IntegrationApplication MaintenanceQuality Assurance Such services shall be used to support multiple IT projects across SEFE's IT estate
The Client intends to award a framework agreement to up to four contractors with a term of four years. Details regarding the call-off process under this framework agreement are described in the procurement documents, including the draft contract.
The contracting authority notes that a request for review pursuant to Section 160(3) GWB is inadmissible if: 1) the applicant became aware of the alleged violation of procurement regulations prior to submitting the request for review and did not raise an objection with the contracting authority within a period of 10 calendar days; the expiration of the deadline under Section 134(2) remains unaffected, 2) violations of procurement regulations that are apparent from the notice are not raised with the contracting authority by the deadline for submission of bids or applications specified in the notice at the latest, 3) Violations of procurement regulations that are only apparent in the procurement documents are not raised with the contracting authority by the deadline for submitting bids or applications at the latest; 4) More than 15 calendar days have elapsed since receipt of the contracting authority"s notification that it does not intend to remedy a complaint.
Documents to be submitted in the pre-qualification process (TNW): Self-Declaration Form (Application Form) (to be submitted with the Application for Participation (TA) via self-declaration): The Self-Declaration Form must be completed in full and signed in writing. All necessary attachments or supporting documents must be enclosed separately. The self-declaration form can be downloaded from the web address provided in this notice. The model contract has been included for the TNW for informational purposes. Fee proposals and handouts are to be prepared only upon request by the bidders selected for the negotiated procedure. Electronic submission of applications in text form, with an advanced/qualified signature, is permitted. All communication in this procedure takes place on the procurement portal via the email address provided during initial registration. The applicant/bidder must ensure continuous availability throughout the entire procedure. Inquiries received by mail, email, or fax cannot be answered. The applicants formally declare that the information provided by them in the self-declaration they submitted is accurate and correct, and that they are aware of the consequences of serious misrepresentation. Applicants formally declare that they are able to provide the certificates and other documentary evidence mentioned without delay upon request. Documents not submitted electronically by the deadline will not be considered. The client reserves the right, in accordance with the SektVO, to request missing evidence and declarations. Applications that do not contain all required information, supporting documents, and references will be excluded unless these are submitted within a specified deadline upon request. Copies of supporting documents will be accepted provided they do not give rise to doubts regarding their conformity with the original. Attachments to the applicant"s TA must not exceed 100 MB. Further subcontracting not announced in the TA is permitted only with the prior written consent of the Client. Advertising brochures/materials introducing the applicant, as well as additional information beyond what is required, are not desired. These will not be considered in the process. No costs will be reimbursed for the preparation of the application and bid documents. Note: Submission of written declarations of commitment in accordance with the Subcontracting Ordinance (SektVO) from subcontractors (SU) and, if applicable, their subcontractors, provided that the bidder to whom the contract is to be awarded, or a member of a joint venture to which the contract is to be awarded, relies on the technical competence or performance capacity of the subcontractor, with a signature in writing. If the subcontractors" letters of commitment cannot be submitted at the time of the intended award of the contract, subsequent exclusion will occur due to lack of suitability (exclusion criterion). If the notice or documents relating to the competitive bidding process contain ambiguities or contradictions, or if, in the applicant"s opinion, they violate applicable law, the applicant must immediately notify the contracting authority in writing. If this is not done, the applicant is precluded from raising these objections. Personal pronouns used in the tender documents apply to all genders. Unless expressly stated otherwise, "applicant" or "bidder" refers to both individual companies and consortia, and "contractor" refers to the bidder or the consortium.
The contracting authority will, where possible, request missing documents in accordance with Section 51 SektVO.

Proof of financial and economic standing - 1) Declaration of the economic operator's average fee income for the last three financial years (in gross EUR) (Note: The average annual minimum fee income in the area of IT Professional Services is set at EUR2.0 million gross.)

The applicant may use the same customer reference, for multiple references below, where it has provided different IT professional service types for the same customer.
Auswahlkriterien - The contracting authority will formally and substantively review and evaluate the requests to participate received within the deadline based on the evidence and declarations specified in the contract notice.The selection will be carried out among the formally admissible requests to participate using an evaluation matrix (EM). Between 0 and 3 points may be awarded for each selection criterion. The score for each criterion will be weighted in accordance with the defined weighting.The ranking will be determined based on the total score achieved out of a maximum of 300 points. Up to three applicants with the highest scores will be invited to submit a tender. If several applicants equally meet the requirements within the specified maximum number and the number of applicants is too high, a draw will be used to decide among them.

For bidding consortia (BG): Joint and several liability with an authorized representative. Submission of a declaration stating that members of the BG (consortium) are jointly and severally liable, even after the dissolution of the consortium. The BG must appoint an authorized representative. The provided form, which is attached to the participation documents as an appendix, may be used for the declaration. This must be signed in writing by all members. The proof must be submitted with the application. The contracting authority reserves the right to request additional documents proving the admissibility of the cooperation in the form of a BG (Section 1 GWB). Should the composition of an existing joint bidder change during the course of the procedure, or should an individual bidder wish to continue the procedure as a joint bidder, this is only permissible with the written consent of the contracting authority. Such consent will not be granted in any case if the change significantly impairs the competition or if the change has an impact on technical expertise, performance, and reliability.
